These Terms of Service ("Terms") govern your use of Genr8, a content generation platform operated by Mohammad Khairi bin Ali, registered in Malaysia under SSM ("Genr8", "we", "us", or "our"). By accessing or using Genr8 at genr8.my, you agree to be bound by these Terms.

1. The Service

Genr8 is an AI-powered content generation tool that helps users create captions, posts, and social media content for connected social media accounts. The service includes:

• AI caption and content generation
• Content scheduling and queue management
• Publishing to connected social accounts (Threads, Instagram, Facebook, TikTok, Twitter/X)
• Voice and tone personalisation
• Analytics and content performance tracking

2. User Approval Before Publishing

All content generated by Genr8 must be reviewed and explicitly approved by you before it is published to any social media platform. Genr8 will never automatically publish content without your action. You are solely responsible for the content you approve and publish through Genr8.

3. Account Registration

You must register an account to use Genr8. You agree to:

• Provide accurate and complete information during registration
• Keep your password secure and not share your account
• Notify us immediately of any unauthorised account access
• Be responsible for all activity under your account

4. Acceptable Use

You agree not to use Genr8 to:

• Generate or publish content that violates any applicable law
• Generate spam, misleading, or fraudulent content
• Violate the terms of service of any connected social platform
• Infringe the intellectual property rights of others
• Harass, threaten, or harm any person
• Attempt to reverse-engineer, scrape, or exploit the Genr8 platform

5. Connected Social Accounts

When you connect a social account to Genr8 (including Meta Threads, Instagram, or Facebook accounts), you authorise Genr8 to access that account using the permissions you grant during the OAuth connection flow. You may disconnect any social account at any time from your Genr8 settings or directly from the social platform's settings.

You remain solely responsible for your social accounts and the content published through them. Genr8 is not responsible for actions taken by social platforms on your accounts.

6. Content Ownership

You own all content you create, approve, and publish through Genr8. By using the service, you grant Genr8 a limited, non-exclusive licence to store and process your content solely for the purpose of providing the service to you. We do not claim ownership of your content and do not use it to train AI models.

7. Subscription and Payment

Genr8 offers paid subscription tiers. By subscribing:

• You authorise us to charge your payment method on a recurring basis
• Subscriptions renew automatically unless cancelled before the renewal date
• Refunds are issued at our discretion in cases of service failure
• You may cancel your subscription at any time from your account settings

8. Disclaimer of Warranties

Genr8 is provided "as is" without warranties of any kind, either express or implied. We do not guarantee that the service will be uninterrupted, error-free, or that AI-generated content will meet your expectations. You use the service at your own risk.

9. Limitation of Liability

To the maximum extent permitted by Malaysian law, Genr8 and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service, including but not limited to loss of revenue, business, or data. Our total liability to you shall not exceed the amount you paid for the service in the 3 months preceding the claim.

10. Meta Platform Compliance

Genr8 operates in compliance with Meta's Platform Terms and Developer Policies. When you use Genr8 to publish content to Meta platforms (Threads, Instagram, Facebook), you agree to comply with Meta's Terms of Service and Community Standards. Genr8 is not affiliated with or endorsed by Meta Platforms, Inc.

11. Termination

We may suspend or terminate your account if you violate these Terms. You may terminate your account at any time by contacting us at hello@genr8.my. Upon termination, we will delete your personal data in accordance with our Privacy Policy.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes via email or in-app notification. Continued use of Genr8 after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of Malaysia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Malaysia.
